Martinsburg couple sues neighbor for dog attack

MARTINSBURG -- A Martinsburg couple is suing their neighbor for injuries sustained in an attack by the neighbor's dog.

Kenneth Boyle was the owner of a black male pit bull known in the neighborhood to be vicious and/or dangerous, according to a complaint filed June 3 in Berkeley Circuit Court.

On May 29, 2009, the dog, viciously and without provocation, attacked Michael Lance, causing severe injuries, according to the suit.

Lance claims at the time of the attack, Boyle kept the dog without adequate safeguards and/or warnings to protect the public.

Lance and his wife, Margaret Lance, are seeking compensatory and punitive damages for reckless disregard for the safety of others. They are being represented by Dale A. Buck.
