CHARLESTON -- A Kanawha County couple is suing CMH Homes and the Home Show-Barboursville after they claim they did not install a manufactured home properly.
In October 2006, Angel Rodriguez and Robert Ash entered into a purchase contract with the defendants for the purchase of a new manufactured home, according to a complaint filed July 2 in Kanawha Circuit Court.
The couple claims the defendants failed to properly install the home as required by law and after they began to live in the home, they discovered and experienced repeated non-conformities that impaired the use, value and/or safety of the home.
Despite Rodriguez and Ash's efforts to allow the defendants the opportunity to repair the home, they failed and/or refused to repair the home in a timely manner so as to bring it into conformity with the warranties, according to the suit.
The couple claims the defendants breached the express and implied warranties; misrepresented the condition of the home; misrepresented the costs of the transaction; and failed to remedy the problems with the home.
Rodriguez and Ash are seeking compensatory and punitive damages. They are being represented by Cameron S. McKinney and David L. Grubb.
The case has been assigned to Circuit Judge Louis Bloom.
