HUNTINGTON -- A woman is suing DM Motor and Dutch Miller Enterprises after she claims the 2004 Hyundai Sonata GLS she purchased was defective.
On July 11, 2008, Deanna Thomas purchased the vehicle from the defendant, according to a complaint filed July 9 in Cabell Circuit Court.
Thomas claims since the purchase of the vehicle she has experienced problems with the brake system, problems with the rotors, replacement of the rotors, problems with the wheels, engine using/losing oil, problems with shifting up and down while driving and problems in the steering of the vehicle.
The defendants have had numerous opportunities to repair the vehicle and failed to adequately do so, according to the suit.
Thomas claims the vehicle continues to be out of conformity with its warranties, which substantially impairs the use and market value of the vehicle.
Thomas is seeing revocation of acceptance of the vehicle and refund of the purchase price and damages for repair costs. She is being represented by William L. Mundy.
The case has been assigned to Circuit Judge David M. Pancake.
