Former employee sues Sedwick for Wage Payment & Collecton Act violations

CHARLESTON -- A former employee is suing Sedwick Claims Management Services after she claims it violated the West Virginia Wage Payment & Collection Act.

Kim Withrow was employed by Sedwick from Nov. 7, 2007, until May 2010, as a claims examiner, according to a complaint filed July 9 in Kanawha Circuit Court.

Withrow claims that the defendant would require her and other employees to work anywhere from eight to 36 hours a week of overtime without any payment.

Sedwick violated the West Virginia Wage Payment & Collection Act by failing to pay Withrow wages due and owing, which she earned, according to the suit.

Withrow is seeking judgment for an amount equal to loss of all wages with interest and liquidated damages. She is being represented by J. Michael Ranson and Cynthia M. Ranson.

The case has been assigned to Circuit Judge Louis Bloom.
