CHARLESTON -- A Logan County woman is suing McDonald's and the South Charleston location's manager after she slipped and fell.
On July 23, 2008, Deshawna Carter was a customer at the McDonald's restaurant and was stepping back from the counter to get some ketchup when she slipped on the wet floor and fell, according to a complaint filed July 15 in Kanawha Circuit Court.
Carter claims the floor had been recently mopped and remained wet, and management, including Pam Turner, failed to warn customers of the wet floor.
The defendant failed to properly maintain the floors; failed to warn its customers of the wet floor; failed to conduct any regular inspection of the front area of its business for hazards; failed to provide reasonable and adequate maintenance to its floors; and violated local, state and federal health and building codes and regulations, according to the suit.
Carter claims she sustained a right distal radius fracture; left shoulder strain; lumbar spine strain; left elbow injury; swelling and bruising; carpal tunnel syndrome; constant pain and soreness in her left shoulder, left elbow, right wrist and right arm; a nervous condition; and nightmares and sleeping problems.
Carter is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Pamela A. Lambert.
The case has been assigned to Circuit Judge Charles King.
