Woman says three people are responsible for family member's death

HUNTINGTON -- A Huntington woman is suing three individuals after she claims they are responsible for the death of a family members.

On July 19, 2008, Pamela Hayes was a passenger in a vehicle operated by S.M. Hayes and owned by Jeffery Smith, according to a complaint filed July 14 in Cabell Circuit Court.

Janice Y. Hayes claims S.M. Hayes and John Doe negligently and carelessly failed to maintain control of their vehicles, which caused Pamela Hayes' death.

As a result of the defendants' negligence, which resulted in the death of Pamela Hayes, the Estate has incurred expenses for ambulance, funeral, burial and other costs and expenses, according to the suit.

Janis Hayes claims she and Pamela Hayes' other survivors have suffered great pain and anguish of body and mind; sorrow and emotional distress; and losses of solace, comfort, support, services, society, companionship, guidance, advice and love.

Janis Hayes is seeking compensatory damages. She is being represented by Michael A. Woelfel.

The case has been assigned to Circuit Judge F. Jane Hustead.
