*On Mar. 19, 2009, at Wal-Mart's store in Triadelphia, plaintiff was clearing space in the back of his car for the merchandise he had purchased. A forklift operator drove the forklift very close to plaintiff's car. Lively stepped backwards; he tripped over the forklift and severely injured himself. As a direct and proximate result of defendant's negligence, injuries were suffered to his lower back and ankle. A compensatory judgment is sought.
