John and Chasidy Hardesty vs. International Coal Group, Hunter Ridge Coal Co., Wolf Run Mining, Fairchild International Inc.

* In August 2008, Hardesty was employed by Sentinel Mines. He was working on his knees attempting to splice a mining belt and while doing so he was run over by a scoop. The scoop was being operated by an employee of Wolf Run Mining who was unaware of Hardesty's location. As a result, Hardesty suffered serious and permanent injuries. This accident was similar to one that occurred at Sentinal Mine in May of 2008 which resulted in the death of that worker. The Hardesty's are seeking compensatory, general and punitive damages, pre and post judgment interest, costs and attorney fees.

Ruth Michael Administratix James A. Michael Estate vs. Michelle Michael

* When James Michael passed away in November 2008, Michelle Michael and their children Jennacatherine and James Michael II were his sole heirs. In June 2007, Michelle Michael was convicted in the death of her husband James Michael. West Virginia Code provides that no person who kills another shall acquire any monies or property and, as such, the children should be entitled to inherit their father's estate. Michael contends her conviction is not final and no distribution can be made. Ruth Michael is seeking declaration from the court with respect to the distribution of the estate.

Richard C. Corder Jr., vs. Consol Energy, Seebach America and Shumar's Welding and Machine Service

* Corder is seeking damages for injuries and losses sustained while working as a mechanic on a longwall panel. He suffered an ocular laceration and contusion of the right eyeball, blow out fractures of the orbital floor and closed fractures of the nasal bones. Corder alleges Consol exposed him to unsafe working conditions and that Seebach's hydraulic oil filter was defective and lacked adequate warnings and instructions.
