* On Sept. 11, 2008, Cummings purchased a new 2009 Toyota Tacoma from Bert Wolfe Ford Toyota for $26,965. Cummings claims after purchasing the vehicle, he began to experience repeated non-conformities with the vehicle and after a reasonable number of attempts, the defendant did not conform the vehicle to its warranty, nor replace the vehicle with a comparable new vehicle that did conform to the warranty. He is seeking revocation of acceptance and refund of the purchase price of the vehicle, including sales tax, license and registration and other reasonable expenses; damages for repair costs; and damages for loss of use and annoyance or inconvenience.

* The plaintiffs purchased real estate in Dunbar from Byrd on Aug. 19, 2008. They claim Byrd failed to disclose any problems with the property and indicated that he "has never occupied the land." Walker and Stennett claim they later learned that the previous owner disclosed moisture and/or water problems in the basement of the property to Byrd when he had purchased the property and that the defendants attempted to correct the problems, but did so in a "negligent manner, which allowed the moisture and/or water problems to continue after the plaintiffs purchased the property." The plaintiffs are seeking compensatory and punitive damages with pre- and post-judgment interest.
