HUNTINGTON -- A former employee is suing PepsiCo after he claims it violated the West Virginia Wage Payment and Collection Act.
On March 15, Brian Curry began working for PepsiCo, which was doing business as Frito Lay, according to a complaint filed Aug. 12 in Cabell Circuit Court.
On May 20, Curry's employment was terminated.
During Curry's employment, the defendant paid him via direct deposit to his People's Bank account, but did not make a direct deposit to his account until May 25, in the amount of $517.04, according to the suit.
Curry claims the check was short in the amount of approximately $200, which represented his average bi-weekly commissions.
PepsiCo also did not reimburse Curry for his expenses until July 13, and failed to pay him for one week of accrued vacation pay, according to the suit.
Curry is seeking all damages under the West Virginia Wage Payment and Collection Act with pre- and post-judgment interest. He is being represented by Timothy P. Rosinsky.
The case has been assigned to Circuit Judge F. Jane Hustead.
