Del. company sues Taylor Contracting for failure to pay for cement

WAYNE -- Holcim (US), Inc., is suing Taylor Contracting/Taylor Ready Mix after it claims the company failed to pay for cement that amounted to nearly $38,000.

In November and December 2008, the defendant accepted 14 shipments of cement from Holcim, but failed and refused to pay for the cement, according to a complaint filed Aug. 6 in Wayne Circuit Court.

Holcim claims that the acceptance of the cement and signed invoices created contracts that required the defendant to pay the amount of each invoice by the last day of the month following the shipments.

The defendant breached the contracts by failing to pay for the goods, according to the suit.

Holcim is seeking damages in the amount of $37,093.36 with pre- and post-judgment interest. It is being represented by Bruce M. Jacobs and Kimberly K. Parmer.

The case has been assigned to Circuit Judge James H. Young.
