HUNTINGTON -- An Ironton, Ohio, man is suing Danny Sullivan Excavating and an individual after he claims they are responsible for his injuries while he was working.
Wesley Harmon was employed by Danny Sullivan Excavating and was contracted by Sandra L. Lewis to demolish parts of the old Dr Pepper Plant which was owned by Lewis, according to a complaint filed Aug. 19 in Cabell Circuit Court.
On Nov. 4, 2008, Harmon was performing demolition work for the defendants when the skid steer loader he was operating came into contact with a five gallon can of 98 percent pure sulphuric acid, causing the can to explode and injure him, according to the suit.
Harmon claims he was unaware of the can of sulphuric acid and that the defendants failed to warn him of its existence, which caused him physical and mental pain and suffering.
Harmon is seeking compensatory and punitive damages. He is being represented by R.R. Fredeking II and Paul E. Biser.
The case has been assigned to Circuit Judge F. Jane Hustead.
