HUNTINGTON -- A Cabell County woman and her husband are suing the Southwestern Community Action Counsel after they claims her employment was wrongfully terminated.

On Feb. 16, 2009, Anita Laslo was hired to work as a home care assistant by the defendant, according to a complaint filed Aug. 20 in Cabell Circuit Court.
On March 19, 2009, Laslo claims she suffered an on-the-job injury and went to the emergency room the following day, where she was diagnosed with a strain in her lower back.
After her trip to the emergency room, Laslo began seeing Dr. David Steel for follow-ups, according to the suit, and while the condition of her lower back gradually improved, Steel decline to release her to return to work.
On July 15, 2009, Laslo claims BrickStreet Mutual Insurance Company sent her a letter informing her she had been approved for temporary total disability benefits through Aug. 6, 2009.
On July 22, 2009, Laslo settled her workers' compensation claim with BrickStreet and on Aug. 5, 2009, the defendant discharged her for job abandonment, according to the suit.
Laslo claims the defendant discharged her before her treating physician had released her to return to work and while she was still receiving temporary total disability benefits from BrickStreet.
Laslo and her husband, Gary Laslo, are seeking compensatory and punitive damages. They are being represented by J. Patrick L. Stephens.
The case has been assigned to Circuit Judge F. Jane Hustead.
