CHARLESTON -- A Raleigh County man and his wife are suing Remington after he sustained injuries on the job.
On Nov. 13, 2008, Charles Martin was working as an electrician for Remington at its Winchester Mine, according to a complaint filed Aug. 24 in Kanawha Circuit Court.
While working, Martin was assigned the task of working on a shuttle car in a section of the mine. He claims while retrieving tools from a personnel carrier located nearby, a rib roll occurred, causing rib coal and roof rock to strike him and pin him against the personnel carrier.
As a result of the incident, Martin suffered severe injuries and damages.
Martin claims the defendant exposed him to an unsafe working condition that presented a high degree of risk and strong probability of serious injury or death.
Martin and his wife, Rebecca Ann Martin, are seeking compensatory and punitive damages. They are being represented by Robert D. Cline, Robert A. Campbell and R. Chadd Duffield.
The case has been assigned to Circuit Judge James C. Stucky.
