Men sue GMC, Moses Automotive for defective vehicle

CHARLESTON -- Two men are suing GMC and Moses Automotive for defects in a vehicle they purchased in 2007.

On June 29, 2007, Charles A. Maxant and Michael C. Maxant purchased a 2007 Pontiac G6 from the defendants, according to a complaint filed Aug. 23 in Kanawha Circuit Court.

The men claim that since purchasing the vehicle, they have experienced repeated non-conformities with it, including experiencing significant engine problems on at least seven different occasions.

The defendants breached the implied warranty of the vehicle and violated the West Virginia Consumer Credit and Protection Act, according to the suit.

The plaintiffs are seeking revocation of acceptance and refund of the purchase price of the vehicle and damages for repair costs. They are being represented by Damon L. Ellis.

The case has been assigned to Circuit Judge Jennifer Bailey.
