Couple sues Nissan for defective vehicle

CHARLESTON -- A couple is suing Nissan North America after they claim the vehicle they purchased was defective.

On Sept. 8, 2009, Bobby Adkins and Kathy Adkins purchased a new 2009 Nissan Murano from C & O Motors, Inc., with a purchase price of $35,660.48, according to a complaint filed Aug. 20 in Kanawha Circuit Court.

Withing one year of the purchase, the plaintiffs claim they noticed numerous problems with the vehicle, including issues with the locks, battery/alternator, windows, panel and radio.

The couple claim they returned the vehicle to the defendant numerous times for repair, but the problems still persist.

The couple is seeking revocation of purchase agreement and full refund of the purchase price of the vehicle. They are being represented by Timothy P. Rosinsky.

The case has been assigned to Circuit Judge Tod J. Kaufman.
