D. Max and Joyce Francis v Matthew Darmelio MD and Mountainstate Orthopedic Assoc.

* In June 2008, D. Max Francis received a left knee replacement. After follow up visits to Dr. Darmelio, it was noted Francis had only 70 degrees of flexion in his left knee. Darmelio suggested doing an additional scar incision and downsizing, or replacing, the polyetheline liner. After this additional sugery was performed, Francis still only had 70 degrees of flexion. Francis advised Darmelio he would seek a second opinion. A revision of the left knee replacement was done at UPMC. Francis is seeking judgment for compensatory damages, attorney fees, pre- and post-judgment interest.

Louise and Leonard Devault v Mark L. Johnson, MD, Jerome G. Johnson, MD, Mary Edwards, MD, Morgantown Surgical Associates, Mon General Hospital

* Louise Devault is seeking judgment against defendants for injuries sustained during a biopsy of a mass in her left breast. Devault claims that during the biopsy, her left mammary artery was injured, resulting in hemopneumothorax, hypovolemic shock and cardiac arrest. As a result, additional surgery was needed to correct the damage. Devault is asking for punitive damages, costs, and pre and post judgment interest.
