Woman sues Kroger for injuries

CHARLESTON -- A woman is suing Kroger after she claims she was injured in its Smithers store location.

On May 15, 2009, April Donna Hobbs was shopping when four or five cases of water fell from a shelf and struck her in her shoulder and right foot, according to a complaint filed Sept. 1 in Kanawha Circuit Court.

Hobbs claims the defendant owned and controlled the shelf that the water was on and breached its duty of care and maintenance by allowing the shelf to be unsecured and/or become unsecured.

As a result of the defendant's negligence, Hobbs sustained injuries to her shoulder and foot, according to the suit.

Hobbs is seeking compensatory and punitive damages. She is being represented by Paul M. Stroebel.

The case has been assigned to Circuit Judge Carrie Webster.
