Parkersburg couple names 58 companies in asbestos suit

CHARLESTON -- A Parkersburg man and his wife named 58 defendants in an asbestos-related suit, claiming they are responsible for his mesothelioma.

James R. Hinton was diagnosed with mesothelioma on July 7, according to a complaint filed Aug. 25 in Kanawha Circuit Court.

Hinton, who was employed by Union Carbide in South Charleston from 1946 until 1991 as an operator, claims he has never smoked.

The defendants are being sued upon theories of negligence; contaminated buildings; breach of expressed/implied warranty; strict liability; intentional tort; conspiracy; misrepresentations; and post-sale duty to warn, according to the suit.

Hinton and his wife, Glendene F. Hinton are seeking a jury trial to resolve all issues involved in their case. They are being represented by John E. Sutter.

The case has been assigned to a visiting judge.
