Jefferson Co. woman sues Atkins Law Offices, NCO Financial Systems for state code violations

CHARLESTON -- A Jefferson County woman is suing Atkins Law Offices and NCO Financial Systems after she claims they are in violation of the West Virginia Consume Credit and Protection Act and the Fair Debt Collection Practices Act.

Julia B. Gray is a consumer and was purposefully abused and harassed by the defendants , according to a complaint filed Aug. 31 in Kanawha Circuit Court.

Gray claims the defendants are debt collectors who sought to collect an alleged debt from her and used language intended to unreasonably abuse her.

The defendants made false representations to Gray that the alleged existing obligation would be increased through the addition of improper collection fees and costs if she failed to immediately pay the amount they alleged that she owed, according to the suit.

Gray is seeking declaratory judgment declaring the defendants in violation of the West Virginia Consumer Credit and Protection Act and the Fair Debt Collection Practices Act; compensatory and punitive damages; and pre- and post-judgment interest. She is being represented by G. Christopher Gleason.

The case has been assigned to Circuit Judge James C. Stucky.
