Man sues Ford for defective vehicle

CHARLESTON -- A man is suing Ford Motor Company after he claims a vehicle he purchased was defective.

On Oct. 22, 2007, David Rubio purchased a new 2008 Ford Explorer from Moses Ford in St. Albans for about $35,526.67, according to a complaint filed Aug. 31 in Kanawha Circuit Court.

Rubio claims after purchasing the vehicle, he began to experience repeated non-conformities with it.

"After a reasonable number of attempts, the manufacturer did not conform the new motor vehicle to the warranty, nor replace the vehicle with a comparable new motor vehicle which did conform to the warranties," accord to the suit.

Rubio claims he suffered annoyance, inconvenience and incurred expenses for alternative transportation.

Rubio is seeking revocation of acceptance and refund of the purchase price of the vehicle and damages for repair costs. He is being represented by Michael L. Glasser.

The case has been assigned to Circuit Judge Carrie Webster.
