* On Aug. 28, 2008, Ra'Sean Gray was a student at West Virginia State University and was living in a dorm room maintained by the university when there was an explosion at the Bayer plaint in Institute, which released chemicals into the air. Portia Gray claims her son stayed indoors until an all clear signal sounded and then returned to his dorm room, which he found covered in dust or soot, the window facing the plant open and a foul smelling odor in the room. She claims her son notified the school several times about the dust or soot and the odor. On Sept. 17 and Sept. 18, 2008, Ra'Sean Gray went to the emergency room of Thomas Memorial Hospital for shortness of breath and chest pains. On Sept. 18, 2008, he was declared dead at the hospital, according to the suit. Portia Gray claims the defendants are responsible for his death. She is seeking damages in an amount believed to be in excess of $10 million.

* The plaintiff claims Tennant intends to provide a single ballot for both the upcoming Nov. 2 general election and the concurrent special election to fill the vacant seat in the office of United States Senator. The committee claims this is against West Virginia Code. It is seeking to enjoin the defendant from printing the ballots or distributing them if they have already been printed and to enjoin the defendant from ultimately employing a ballot that does not comport with the separate elections requirement of West Virginia Code.
