CHARLESTON -- A Charleston man is suing Withrow Contractors and its owners after he claims they failed to uphold their contract.
On March 30, Robert Brunner signed a contract with James Withrow and Charles Withrow for repair work to the outside of his home, according to a complaint filed Sept. 1 in Kanawha Circuit Court.
Brunner claims he wrote seven personal checks for work and materials to the defendants for a total amount of $4,529 from March 29 until April 18. He claims the defendants failed to perform all work promised.
On April 19, the defendants breached their contract with Brunner by failing to complete the work outside of his home, which caused him to suffer loss of income and loss of use, according to the suit.
Brunner is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Kathy A. Brown.
The case has been assigned to Circuit Judge James C. Stucky.
