Dunbar man sues Family Dollar for injuries

CHARLESTON -- A Dunbar resident is suing Family Dollar after he was injured at its store in the Dunbar Shopping Plaza.

Zamias Services Inc. was also named as a defendant in the suit.

On Sept. 20, 2008, Jackie L. Goff was a customer of Family Dollar and was walking toward the store through a parking lot owned by Zamias Services when the asphalt in the parking lot gave way and sunk, causing him to fall forward and hit his head and elbow on the sidewalk directly in front of the store, according to a complaint filed Sept. 2 in Kanawha Circuit Court.

Goff claims the defendants knew that the parking lot was in an unreasonably dangerous condition and neither defendant had corrected nor warned him of it.

The defendants were negligent in failing to correct the problem or warn Goff, according to the suit.

Goff is seeking compensatory damages. He is being represented by Stephen P. Swisher.

The case has been assigned to Circuit Judge Jennifer Bailey.
