Woman sues Charleston attorney over sewer dispute

CHARLESTON –- A Charleston woman is suing an attorney over a sewer dispute.

Mary Collia filed suit against David L. Grubb in Kanawha Circuit Court on Sept. 17. In her two-count count complaint, Collia, 85, alleges Grubb, 59, in an attempt to drain sewage from his office on Virginia Street East, has diverted it into property she owns next door.

According to her suit, Collia alleges Grubb "installed a tap into [her] sewer line, for the purpose of draining sewage from [his] parking lot. The suit does not specify when this occurred.

Nevertheless, Collia says she "at no point gave [Grubb] permission to install the tap into her sewer line." The backup from the increased load into her sewer lines has produced "noxious fumes ... so strong they devalue the house and render the property unlivable."

The house Collia owns next to Grubb's office, the Grubb Law Group, is currently unoccupied. Collia, records show, lives three doors down on the corner of Virginia and Bradford streets.

Grubb, records show, lives further down Virginia Street toward the state Capitol on the 1500 block.

Along with unspecified damages, Collia seeks an injunction prohibiting Grubb from discharging more sewage from his office into her line. She is handling the case pro se.

The case is assigned to Judge Louis H. "Duke" Bloom.
