CHARLESTON -- A Kanawha County man is suing J.K. Harris & Company and Professional Fee Financing Associates after he claims they engaged in deception and fraud.
The defendants engaged in deception and fraud to induce Gary Judy to enter into a contract with them, according to a complaint filed Sept. 10 in Kanawha Circuit Court.
On Nov. 18, 2008, Judy entered into a contract with the defendants for J.K. Harris & Company to provide services to him, according to the suit.
Judy claims he contacted the defendants after seeing and hearing numerous advertisements on television and radio promoting J.K. Harris & Company's ability to settle consumers' tax liabilities to federal and state tax authorities "for pennies on the dollar."
The advertisements led Judy to believe the work on his file would be handled in the defendant's local Charleston office by tax experts, tax professional and ex-IRS agents, according to the suit.
Judy claims the defendants did not provide the promised services to him. He claims the defendants also refused to refund the fees to him.
"Defendants' conduct is part of a pattern and practice of unconscionable unfair or deceptive acts or practices victimizing West Virginia consumers," according to the suit.
Judy is seeking that the contract and resulting debt involved be declared canceled and compensatory and punitive damages. He is being represented by Cameron S. McKinney and David L. Grubb.
The case has been assigned to Circuit Judge Carrie Webster.
