HUNTINGTON -- A Cabell County man is suing Supervalu Holdings and an unknown person after he claims he was injured while working.
Supervalue Holdings is doing business as Black Diamond Fruit and Produce Co.
On Sept. 10, 2008, Michael L. Hensley was subjected to hazardous, unsafe and dangerous conditions while in the course of his job activities when he was seriously injured by a forklift when it lost power, according to a complaint filed Sept. 9 in Cabell Circuit Court.
The plaintiff was victimized "by the existence of defective equipment used in completion of his work duties," according to the suit.
Hensley claims the defendants' equipment was in dangerous disrepair and that they owed a duty to exercise reasonable care and failed to do so.
Supervalu Holdings knowingly caused Hensley to work under unsafe and dangerous conditions, according to the suit.
Hensley is seeking compensatory and punitive damages. He is being represented by Michael A. Woelfel.
The case has been assigned to Circuit Judge David M. Pancake.
