* The decedent was employed by Braden's Towing as a mechanic, on Nov. 17, 2009. Braden's employees commonly used a wheel cleaner solution containing hydrofluoric acid, a colorless and extremely hazardous liquid chemical. Unbeknownst to Gibbons, Braden stored acidic wheel cleaner in a water bottle used for detailing automobiles as opposed to placing the chemical in a proper OSHA approved container. At 9:30 p.m., less than three hours after his admission to Wheeling Hospital, presumably in stable condition, Mr. Gibbons died as a result of ingestion of hydrofluoric acid.

* On June 4, 2008, plaintiff presented to the Ohio Valley Medical Center's ER with complaints of a dog bite to the left hand. Plaintiff was a high risk for infection as he was a known diabetic, had a history of ulcerative colitis and was a smoker. Employees deviated from the standard of care by failing to appropriately order an x-ray. He returned to the ER on June 28, 2008, with increased pain and was at that time in a cast. Undiagnosed complications developed and intense inflammation required intensive IV therapy and surgery.
