McFarlan, who is black, claims he was subjected to harassment because of his race, and the defendants were aware on March 11, 2010, that discharging an employee for reporting and opposing racial harassment was an unlawful employment practice in violation of the West Virginia Human Right Act. He is seeking an amount of relief to be determined.
