CHARLESTON -- A man and his wife are suing 89 companies he claims are responsible for his mesothelioma.
On July 29, Raymond Chaney was diagnosed with mesothelioma, according to a complaint filed Sept. 27 in Kanawha Circuit Court.
Chaney claims he smoked one-half pack of cigarettes per day from 1944 until 1964, but then quit.
The defendants are being sued upon the theories of negligence, contaminated buildings, breach of expressed/implied warranty, strict liability, intentional tort, conspiracy, misrepresentations and post-sale duty to warn, according to the suit.
Chaney and his wife, Marjory I. Chaney, are seeking a jury trial to resolve all issues involved. They are being represented by Victoria Antion, James A. McKowen and Brownwyn I. Rhinehart.
The case has been assigned to a visiting judge.
