Fayette Co. man sues AEP for injuries

CHARLESTON -- A Fayette County man is suing AEP after he claims it is responsible for injuries he sustained from a fall.

On July 15, 2009, Charles Legg was working for SuddenLink Communications and was attempting to climb a utility pole owned by the defendant using an extension ladder when the utility pole gave way, according to a complaint filed Sept. 29 in Kanawha Circuit Court.

Legg claims he fell approximately 12 feet to the ground and was injured.

AEP was negligent in failing to inspect and maintain the utility pole, causing it to give way and causing Legg's injuries, according to the suit.

Legg is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Christopher J. Heavens.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
