CHARLESTON -- A Milburn, Okla., couple says Cintas Corporation is responsible for injuries sustained at a post office in Clendenin.
John Doe, an unknown employee and servant of Cintas Corporation, was also named as a defendant in the suit.
On Oct. 20, 2008, Mary S. Boggs went to the United States Post Office in Clendenin to retrieve her mail and was leaving the post office when she tripped over the floor mat and was injured, according to a complaint filed Oct. 8 in Kanawha Circuit Court.
Boggs claims the mat had several places around the outer edge that were "hooved" up and not lying flat on the floor. She claims her right foot got snagged in one of these places, which is what caused her to trip and fall.
When Boggs fell, she injured her left wrist, left shoulder, left elbow, neck, both knees and nose, according to the suit, and her glasses were bent and her wedding bank was broken in the fall.
Boggs claims Cintas Corporation had a duty to maintain the mats and rugs they provided in a reasonably safe condition and failed to do so.
The defendants carelessly and negligently failed to warn Boggs of the unsafe condition, according to the suit.
Boggs and her husband, Dale C. Boggs, are seeking compensatory damages. They are being represented by J. Timothy DiPiero.
The case has been assigned to Circuit Judge Charles King.
