CHARLESTON -- A Raleigh County man is suing Ford Motor Company after he claims a vehicle he purchased was defective and did not conform to its warranty.
On Sept. 14, 2006, Charles England purchased a 2006 Ford F-250 from Hometown Subaru Kia for $33,900, according to a complaint filed Oct. 5 in Kanawha Circuit Court.
England claims after he purchased the vehicle, he experienced repeated non-conformities with it, which substantially impairs the use and market value of the vehicle and caused him to fear for his safety when operating it.
After a reasonable number of attempts, the manufacturer did not conform the vehicle to the warranty, nor did it replace the vehicle with a comparable vehicle that did conform to the warranty, according to the suit.
England is seeking revocation of acceptance and refund of the purchase price of the vehicle; damages for repair costs; and damages for loss of use, annoyance or inconvenience. He is being represented by Michael L. Glasser.
The case has been assigned to Circuit Judge James C. Stucky.
