HUNTINGTON -- Three Ohio residents are suing Sears after they claim they were injured on an escalator.
Sears Holding Corporation; Sears, Roebuck and Co.; and Schindler Elevator Corporation were all named as defendants in the suit.
On Oct. 9, 2008, Lawrence County, Ohio, residents Mildred Ferris, Loren E. Ferris and Melissa Ferris were guests at the defendants' department store in the Huntington Mall, according to a complaint filed Oct. 6 in Cabell Circuit Court.
They claim while they were riding the escalator to the second floor, it malfunctioned and caused them injuries.
By failing to operate and maintain its premises in a safe and careful manner, the defendants breached their duties of care, according to the suit.
The plaintiffs are seeking compensatory damages in an amount not to exceed $75,000. They are being represented by Thomas P. Boggs.
The case has been assigned to Circuit Judge F. Jane Hustead.
