Barboursville woman sues Litmar for slow payment of final wages

HUNTINGTON -- A Barboursville woman is suing her former employer after she claims they violated West Virginia Code by failing to pay her final wages within 72 hours of termination of her employment.

Litmar LLC is doing business as La-Z-Boy Furniture.

Margaret L. Kennedy was employed by the defendant for two years until her discharge on May 5, according to a complaint filed Oct. 13 in Cabell Circuit Court.

Kennedy claims at the time of her discharge, she was due wages in the amount of $2,040.19.

The defendant failed to pay Kennedy's wages as required under West Virginia Code, according to the suit, and is liable to pay three times the amount of wages owed.

Kennedy is seeking judgment in the amount of $8,160.76 with pre- and post-judgment interest. She is being represented by Gregory L. Howard Jr.

The case has been assigned to Circuit Judge F. Jane Hustead.
