Man sues Rio Grande for not paying proper wage, overtime wages

HUNTINGTON -- An employee is suing Rio Grande after he claims the restaurant has failed to pay the proper wages and overtime wages.

Jaime Viladiu began working for the defendant in 2000 at the downtown Huntington location of the local Mexican restaurant chain and was moved to the Fifth Avenue location in 2006, according to a complaint filed Oct. 12 in Cabell Circuit Court.

Viladiu claims he works seven days a week for at least 15 hours per day, averaging 105 hours per week.

The defendant only paid Viladiu for 40 hours of "straight" time at $7.25 per hour and 20 hours of overtime at $12.53 per hour, according to the suit.

Viladiu is seeking all damages available under the West Virginia wage and overtime statues with pre- and post-judgment interest. He is being represented by Timothy P. Rosinsky.

The case has been assigned to Circuit Judge David M. Pancake.
