Hernshaw man sues Ford for vehicle defects

CHARLESTON -- A Hernshaw man is suing Ford Motor Company after he claims the new vehicle he purchased has substantial defects that the company has failed to correct.

On May 6, 2008, James M. Green purchased a 2008 Ford F-150 STX 4X4 from the defendant for $28,000, according to a complaint filed Oct. 13 in Kanawha Circuit Court.

Green claims after purchasing the vehicle, he experienced repeated non-conformities, including lack of appropriate/expected engine power and that the vehicle would not shift properly.

After having made reasonable efforts to allow Ford Motor Company to bring the vehicle into conformity with its warranty, the manufacture did not conform the vehicle nor replace it with a vehicle that did, according to the suit.

Green claims the defendant caused him damage by loss of use of the vehicle.

Green is seeking revocation of acceptance and refund of the purchase price; damages for repair costs; and damages for loss of use, annoyance or inconvenience. He is being represented by Henry E. Wood III.

The case has been assigned to Circuit Judge Louis Bloom.
