Berkeley woman sues male nurse, hospital for assault

MARTINSBURG -- A Berkeley County woman is suing WVU Hospitals East and an unidentified male nurse she claims assaulted her.

On Oct. 3, 2009, Angela Genzlinger was admitted as a patient to a private room on the sixth floor at City Hospital, a health care facility of WVU Hospitals East, according to a complaint filed Oct. 1 in Berkeley Circuit Court.

Genzlinger claims during the early morning hours of Oct. 4 the unidentified male nurse entered her room and told her that he was in the "business of giving hugs."

John Doe approached Genzlinger and proceeded to "fondle the plaintiff's left breast by rubbing his hand up and under her garment and rubbed his erection against the plaintiff," according to the suit.

Genzlinger claims Doe's outrageous conduct constitutes an assault and/or battery and that she was upset and angered by the conduct.

WVU Hospitals East negligently hired, retained and supervised Doe, according to the suit.

Genzlinger is seeking punitive damages. She is being represented by David M. Hammer.
