CHARLESTON -- A woman is suing Freedom Service Center after she claims it breached its contract with her.
Freedom Used Cars and Joe Arthur were also named as defendants in the suit.
On Jan. 21, Kelli Harris purchased a 2001 Ford Mustang from the defendants, according to a complaint filed Oct. 14 in Kanawha Circuit Court.
Harris claims four months after purchasing the vehicle, a problem developed with the clutch, which the defendant repaired and the cost was added to the vehicle's purchase price. Harris was to make additional payments until the cost of the repair was paid.
Shortly after the clutch was repaired, the vehicle developed a problem with the engine, which rendered the vehicle inoperable, according to the suit.
Harris claims the vehicle was towed to Freedom Service Center, where she was informed that it would cost approximately $900 to repair the vehicle.
Unable to pay for the repairs, Harris requested that she be allowed to retrieve the vehicle, but her request was refused and she was informed that she could not retrieve the vehicle until the balance for the repairs to the clutch were paid, according to the suit.
Harris claims she had not missed any payments. She claims she has been without transportation since April 26, has lost her job and has had to depend of public transportation or family and friends.
The defendants breached their contract, according to the suit.
Harris is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Kathy A. Brown.
The case has been assigned to Circuit Judge Tod J. Kaufman.
