CHARLESTON -- Three Marmet couples are suing Mike Enyart & Sons and Ghosh Engineers in three separate cases after they claim they were negligent.
In March, the defendants engaged in busting and removing the asphalt roadway on 87th Street in Marmet, near properties owned by Ruth and Sheldon Jacobs; David and Terri Bray; and Amanda and Clayton Donald Cottrell, according to complaints filed Oct. 25 and Oct. 26 in Kanawha Circuit Court.
The couples claim the defendants were in the process of removing old pipeline and installing new pipeline.
The plaintiffs' properties and homes began experiencing cracks and other problems that had not previously existed prior to the defendants' "negligent construction and engineering work," according to the suits.
The couples claim the defendants are responsible for the problems they have experienced.
The couples are seeking compensatory damages with pre- and post-judgment interest. They are all being represented by G. Patrick Jacobs.
Mr. and Mrs. Jacobs' case has been assigned to Circuit Judge James C. Stucky. Mr. and Mrs. Bray's case has been assigned to Circuit Judge Charles King. Mr. and Mrs. Cottrell's case has been assigned to Circuit Judge Carrie Webster.
