CHARLESTON -- A Kanawha County man is suing General Motors after he claims a vehicle he purchased was defective.
On Aug. 7, 2009, Paul Skaff III purchased a 2006 Hummer H3 for $24,761.58, according to a complaint filed Oct. 25 in Kanawha Circuit Court.
Skaff claims after purchasing the vehicle, he experienced repeated non-conformities with it, which substantially impairs the use and market value of the vehicle.
After a reasonable number of attempts, the manufacture did not conform the vehicle to the warranty, nor replace it with a comparable vehicle with did conform to the warranty, according to the suit.
Skaff claims the defendant's failure to conform the vehicle tot he warranties had caused him to suffer annoyance and inconvenience and incur expenses for alternative transportation.
Skaff is seeking revocation of acceptance and refund of the purchase price and damages for repair costs. He is being represented by Michael L. Glasser.
The case has been assigned to Circuit Judge Jennifer Bailey.
