Shannon E. Smith and Heather Smith vs. West Virginia Division of Corrections and Wolf Performance Ammunition

* Mr. Smith was employed by the Division of Corrections at the Lakin Correctional Facility as a correctional officer. On Sept. 30, 2009, Mr. Smith was directed to attend transition firearm training. He claims many correctional officers experienced problems with the ammunition during training. Mr. Smith was directed to continue firing the gun when, upon pulling the trigger, the ammunition cartridge exploded in his right hand, according to the suit. The Smiths are seeking compensatory and punitive damages with pre- and post-judgment interest.
