* DeMarco was a passenger in a Ford pickup operated by William Kavanagh. While driving on Route 857 in Monongalia County, Kavanagh lost control of the truck, ran off the roadway hitting a tree causing the truck to catch fire. DeMarco and Kavanagh died as a result of their injuries. Tenda alleges that Kavanagh was drinking at The Sports Page and The Back Door before he and DeMarco were involved in the accident. She is seeking judgment for compensatory and punitive damages against the estate of William Kavanagh, The Sports Page, Summit Engineering and The Back Door.
