HUNTINGTON -- Two unnamed individuals are suing Starlight Behavioral Health Services after they claim they were injured.
Seth Fulton Moore, an employee of Starlight, was also named as a defendant in the suit.
On June 5, Robert N. Meadows, who "is an incompetent person," was placed in a residence in the physical care of Starlight Behavioral Health Services, according to a complaint filed Nov. 4 in Cabell Circuit Court.
Jane Doe claims Meadows attacked her outside of her residence and sexually assaulted her, which her minor son, John Doe, witnessed.
Starlight Behavioral Health Services and Moore had actual knowledge or constructive notice of past sexual misconduct by Meadows "which was serial in nature," according to the suit.
Jane Doe claims the defendants negligently allowed Meadows to be unsupervised when she was sexually assaulted.
The plaintiffs are seeking compensatory and punitive damages. They are being represented by Matthew J. Woelfel.
The case has been assigned to Circuit Judge David M. Pancake.
