Two individuals sue Fruth Pharmacy for medication mix-up

HUNTINGTON -- Two individuals are suing Fruth Pharmacy after they were given the wrong prescription.

On Nov. 19, 2008, Fruth Pharmacy improperly filled and gave Thomas C. Hysell and Belinda J. Allen the wrong prescription medication, according to a complaint filed Nov. 19 in Cabell Circuit Court.

Hysell claims he became very ill after taking several doses of the wrong medication, which required him to seek emergency medical treatment on Nov. 23, 2008.

The plaintiffs claim Fruth Pharmacy was negligent for giving them the wrong prescription medication.

As a result of Fruth's negligence, Hysell was injured, according to the suit.

Hysell and Allen are seeking compensatory damages with pre- and post-judgment interest. They are being represented by J. Roger Smith II.

The case has been assigned to Circuit Judge F. Jane Hustead.
