CHARLESTON -- A man is suing a Kanawha County physician after he claims he was injured during surgery.
On Nov. 14, 2008, Roy Whitlatch was injured while Dr. Cyrus J. Mali was performing an ureteroscopy, according to a complaint filed Nov. 12 in Kanawha Circuit Court.
Whitlatch claims Mali perforated his bladder during the procedure, which caused him to develop fluid in his abdomen, ultimately requiring him to undergo a second procedure the following day.
As a result of the negligent surgery performed by Mali, Whitlatch has suffered a loss of enjoyment of life, emotional distress, lost wages, medical bills and other damages, according to the suit.
Whitlatch is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Scott H. Kaminski.
The case has been assigned to Circuit Judge Tod J. Kaufman.
