Kanawha man sues former employer for wage violations

CHARLESTON -- A Kanawha County man is suing Simons Petroleum after he claims it violated the West Virginia Wage Payment and Collection Act.

Johnny Allen Porter Sr. was employed by the defendant from June 10, 2003, until June 14, 2009, according to a complaint filed Nov. 12 in Kanawha Circuit Court.

Porter claims the defendant made specific wage and hour violations, including making drivers work 60-hour weeks and deducting 30-minute lunch breaks each day when drivers did not take lunch breaks.

The defendant's failure to pay Porter his wages is in violation of the West Virginia Wage Payment and Collection Act, according to the suit.

Porter is seeking judgment in an amount equal to the loss of all wages with interest and liquidated damages. He is being represented by J. Michael Ranson, Cynthia M. Ranson and G. Patrick Jacobs.

The case has been assigned to Circuit Judge Jennifer Bailey.
