Charleston couple sues Nissan, dealer for defective vehicle

CHARLESTON -- A Charleston couple is suing Nissan North America and Love Nissan after they claim the vehicle they purchased was defective.

On March 24, 2005, Eric and Bridget Curry purchased a 2005 Nissan Titan for $34,897.85 from the defendants, according to a complaint filed Nov. 12 in Kanawha Circuit Court.

The Currys claim they have returned the vehicle for repair on no less than six occasions for problems associated with the powertrain, the rotors and the electrical system.

The plaintiffs noticed Nissan about their complaints in writing and provided honest feedback regarding Love Nissan's failure to repair the vehicle, according to the suit.

"After notifying Nissan of their complaints and completion of the customer survey, Love refused to provide any further service to the plaintiffs," the complaint states.

The Currys claims Nissan and Love Nissan have also failed or refused to repair or replace the vehicle.

The Currys are seeking compensatory and punitive damages with pre- and post-judgment interest. They are being represented by Harvey D. Peyton and Thomas H. Peyton.

The case has been assigned to Circuit Judge Carrie Webster.
