CHARLESTON -- A New Jersey man and his mother are suing Snowshoe Mountain Inc. and Intrawest Resorts for injuries sustained at the ski resort.
Darrell Salter was employed at the ski resort.
On Dec. 30, 2008, Salter was ordered to operate an ATV outdoors during the night hours, according to a complaint filed Nov. 23 in Kanawha Circuit Court.
Salter claims the defendants did not have in place proper means of monitoring and supervising the safety of its workers, which resulted in him being left unassisted and severely injured on the mountain until the next morning.
The defendants had a duty to inspect and maintain the premises during the performance of work, according to the suit.
Salter claims sustained temporary and permanent injuries; incurred medical bills to treat the injuries; loss of income; physical pain and suffering; mental anguish and emotional distress; loss of enjoyment of life; humiliation and embarrassment; and other damages.
Salter and his mother, Diana Salter, are seeking compensatory and punitive damages with pre- and post-judgment interest. They are being represented by Marvin W. Master and Kelly Elswick-Hall.
The case has been assigned to Circuit Judge James C. Stucky.
