Woman sues GM, dealer for deaths of husband, daughter

HUNTINGTON -- A woman is suing General Motors de Mexico, Dutch Miller Chevrolet and Dutch Miller Enterprises after she claims they are responsible for the deaths of her husband and 13-year-old daughter.

On Dec. 3, 2008, Jeffrey E. George and Hannah E. George were in a vehicle that had been manufactured by General Motors and purchased from Dutch Miller, when it struck a guardrail and instantly became engulfed in flames, according to a complaint filed Nov. 23 in Cabell Circuit Court.

Deborah Oehlschlaeger claims her husband and daughter survived the initial accident and attempted to exit the vehicle, but were unable to, resulting in their deaths from burns and smoke inhalation.

The vehicle, a 2004 Chevrolet Suburban, was "in a defective condition and was unreasonably dangerous when put to its ordinary and intended uses and reasonably foreseeable purposes," according to the suit.

Oehlschlaeger claims the defendants were negligent in manufacturing, designing, assembling, servicing, inspecting, testing, marketing, distributing, exporting and selling the vehicle and for failing to warn of its unreasonably dangerous condition.

Oehlschlaeger is seeking compensatory damages in the amount of $25,000, and punitive damages. She is being represented by James G. Bordas III and Scott S. Blass.

The case has been assigned to Circuit Judge F. Jane Hustead.
